Esinel Ingenieros Takes Key Steps to Comply with Law 20.393 and Ensure Corporate Integrity

Esinel Ingenieros Limitada has taken a significant step toward enhancing transparency and ensuring legal compliance by entering into an agreement with Forensic & Compliance Advisory Ltda. (FC Advisory). This partnership is aimed at developing and implementing a Crime Prevention Model (MPD) to meet the stipulations of Law 20.393.

Since its introduction in Chile in 2009, Law 20.393 mandates that companies establish systems to prevent economic crimes such as money laundering and bribery. Failure to implement such measures can result in the company being held liable for the unlawful actions of its employees and managers. Consequently, compliance with this law is not only a legal obligation but also a crucial investment in ethical conduct and transparency.

The contract, signed in April with FC Advisory, is designed to assist Esinel Ingenieros in fulfilling these legal requirements by creating and implementing a comprehensive MPD. FC Advisory will conduct a thorough review of the company’s internal processes to identify and assess risks related to economic crimes. They will develop a risk matrix to document these risks, including their likelihood, impact, and existing controls. This review will also identify areas for improvement and propose corrective measures.

A key component of the MPD will involve the development of corporate policies that align with current regulations. This will include incorporating compliance clauses into employment and supplier contracts. Additionally, FC Advisory will provide extensive training for the company’s management, executives, and staff. This training will cover essential aspects of crime prevention and regulatory compliance, ensuring that all employees are well-informed of their responsibilities and the procedures they must follow.

The FC Advisory team, led by experts such as Christian Caamaño, a former officer of Chile’s Investigative Police, and Pablo Alfaro, a partner at the firm and forensic auditor, will play a critical role in the implementation of the MPD. Their expertise will be instrumental in ensuring that the MPD is effectively applied and meets high standards of integrity and compliance.

The project is anticipated to take approximately twelve weeks to complete. Through this initiative, Esinel Ingenieros not only reinforces its commitment to legal compliance but also underscores its dedication to ethical and transparent business practices.
